Who We Are
Baer & Bosch Auctioneers, Inc. (“Baer & Bosch,” “we,” “us,” or “our”) is a specialty auction house operating baerandbosch.com (the “Site”). We conduct online auctions and fixed-price sales of vintage and contemporary wristwatches, horology books and ephemera, artist-designed skateboard decks, artist toys, fine art prints, luxury goods, furniture, antiques, and related collectibles.
These Terms & Conditions govern your use of the Site and your participation in any auction, fixed-price sale, or other transaction with Baer & Bosch. By accessing the Site, registering as a bidder, placing a bid, or completing a purchase, you agree to be bound by these Terms & Conditions in their entirety. If you do not agree, do not use the Site or participate in our auctions.
We reserve the right to update these Terms & Conditions at any time. The current version will always be posted on this page with the date of last update. Continued use of the Site or participation in auctions after any update constitutes acceptance of the revised terms.
1. Bidder Registration and Eligibility
To participate in an auction, you must register as a bidder. By registering, you represent that you are at least 18 years of age, that you have the legal capacity to enter into a binding contract, and that all information you provide is accurate and complete.
Baer & Bosch reserves the right to refuse registration, revoke bidding privileges, or block any individual or entity from participating in our auctions at our sole discretion and without obligation to provide a reason. We conduct due diligence on prospective bidders as we deem appropriate. Registration does not guarantee the right to bid. Any registration based on false, incomplete, or misleading information is void, and any sale resulting from such registration may be cancelled at Baer & Bosch’s sole discretion. The registrant shall remain liable for any amounts owed in connection with such a sale.
2. Conditions of Sale
All Property Sold As Is
All property offered by Baer & Bosch is sold strictly “as is.” Neither Baer & Bosch nor any consignor makes any warranty or representation of any kind, express or implied, with respect to any lot, including but not limited to warranties of merchantability, fitness for a particular purpose, description, genuineness, authorship, attribution, provenance, period, culture, source, origin, authenticity, or condition.
No statement made in any auction catalog, listing, advertisement, condition report, invoice, or verbal communication by any representative of Baer & Bosch shall be deemed a warranty, representation, or assumption of liability.
Condition Reports
Condition reports, where provided, reflect the opinion of Baer & Bosch staff only, to the best of their knowledge, and may not be complete. All dimensions and weights in catalog descriptions are approximate. Condition reports may not identify every imperfection, restoration, alteration, or replacement of components. Photographs form part of the description with respect to visible attributes but do not substitute for in-person inspection.
Watches and Timepieces
Watches in water-resistant cases may have been opened to examine movements, and no warranty is made that any watch is currently water-resistant. Baer & Bosch does not guarantee that all individual component parts, including but not limited to movements, cases, dials, hands, crowns, crystals, screws, bracelets, and straps, are original to the watch as delivered from the manufacturer. Watches may have undergone service, repair, or restoration at any point in their history, which may have resulted in the replacement of one or more components with period-correct, manufacturer-genuine, or aftermarket parts. Buyers are encouraged to review all available photographs and condition information and to make independent inquiries prior to bidding.
Mechanical Items
Where a watch or mechanical item is noted as running at the time of inspection, this reflects only that the movement was observed to be running at that specific moment. It is not a guarantee of continued operation, accuracy, or reliability after sale. Baer & Bosch makes no representation regarding timing accuracy, power reserve, or the ongoing working condition of any mechanical item.
Mechanical watches are complex instruments that may require servicing at any time regardless of their apparent condition at inspection. We recommend that all buyers of pre-owned mechanical watches have the watch serviced by a qualified watchmaker upon receipt, so that they may establish a complete service history from the point of their ownership. No warranty of any kind is made regarding the future performance of any mechanical item.
Condition reports may not identify mechanical replacements, wear to the movement, or imperfections to movements, cases, dials, or any separate components.
Artist Skateboards, Art Toys, Prints, and Collectibles
For artist skateboards, art toys, prints, and similar collectibles, Baer & Bosch makes no warranty regarding edition numbers, print quality, substrate, materials, or the accuracy of any attribution, dating, or provenance information provided by the consignor. Where certificates of authenticity are included with a lot, they are passed on as received and Baer & Bosch makes no independent verification of their validity. Items in these categories may show age, wear, storage marks, or other condition issues consistent with their nature as pre-owned collectibles. Buyers are encouraged to review all available photographs and condition information carefully prior to bidding.
3. Bidding
Placing Bids
By placing a bid, you make a binding offer to purchase the lot at the bid amount plus any applicable buyer’s premium and taxes. Bids cannot be retracted once placed. All bids are in US dollars unless otherwise stated.
Buyer’s Premium
A buyer’s premium will be added to the hammer price of each lot sold. The applicable rate will be disclosed in the relevant auction listing. The buyer’s premium is non-negotiable and non-refundable.
Errors and Omissions
Baer & Bosch makes every effort to ensure the accuracy of information contained in auction listings, catalog descriptions, condition reports, and bid confirmations. However, clerical errors, typographical mistakes, and omissions may occur. No such error or omission in any listing, catalog, advertisement, condition report, image, or bid confirmation shall be binding on Baer & Bosch or constitute grounds for cancellation of a sale, adjustment of the hammer price, or any claim against Baer & Bosch. Photographs are provided for illustrative purposes and may not accurately represent color, scale, or condition. It is the buyer’s responsibility to review all available information and make independent inquiries prior to bidding.
Reserve Prices
Some lots may be offered subject to a reserve price, which is the minimum price at which a lot will be sold. Baer & Bosch may bid on behalf of the consignor up to the reserve price. If the reserve price is not met, the lot will not be sold and the auctioneer will pass the lot.
Auctioneer’s Discretion
The auctioneer has absolute discretion to refuse any bid, withdraw any lot at any time before the fall of the gavel, resolve any dispute, and determine the successful bidder. The auctioneer’s decision is final. The starting price of any lot is at the auctioneer’s discretion.
Fall of the Gavel
On the fall of the gavel or, in the case of online auctions, upon the close of bidding and confirmation of the winning bid, risk of loss passes immediately to the successful bidder. The buyer is solely responsible for any loss, damage, or deterioration of the lot from that moment, regardless of whether payment has been made.
Title to the lot does not transfer to the buyer, and no lot will be released for collection or shipment, until payment has been received and cleared in full, including the hammer price, buyer’s premium, and any applicable taxes. Until such time, Baer & Bosch retains full title to the lot.
4. Payment
Accepted Payment Methods
Baer & Bosch accepts payment by bank wire transfer, ACH, Zelle, and Wise.com only.
We do not accept payment by credit card, PayPal, Venmo, Cash App, check, cashier’s check, money order, or any other platform or method not listed above.
If you are contacted by anyone claiming to represent Baer & Bosch and requesting payment by credit card, PayPal, Venmo, Cash App, or any method other than those listed above, do not send payment. Contact us immediately. This is not us.
Payment Deadline
Full payment, including the hammer price, buyer’s premium, and any applicable taxes, is due within seven (7) business days of the auction close. Payment instructions will be provided in the invoice issued following the auction.
Late Payment
Failure to pay in full within seven (7) business days constitutes a material breach of these Terms & Conditions. In the event of late or non-payment, Baer & Bosch reserves the right, at its sole discretion, to cancel the sale, re-offer the lot, retain any deposit paid, charge a penalty equivalent to the buyer’s premium and applicable seller’s commission that would have been earned had the sale completed normally, pursue all available legal remedies to recover amounts owed, and report the default to applicable auction industry databases.
Baer & Bosch will not hesitate to refer unpaid accounts to a collections agency and to pursue legal action against buyers who fail to pay. All costs of collection, including collections agency fees and reasonable legal fees, shall be the responsibility of the defaulting buyer.
In the event of non-payment or late payment beyond 30 days from the auction close, Baer & Bosch reserves the right to cancel the sale and resell the lot by auction or private sale without further notice to the buyer. Any shortfall between the original hammer price and the resale price, together with all costs of resale, shall be the responsibility of the defaulting buyer. Baer & Bosch accepts no responsibility for any loss, damage, deterioration, or disappearance of the purchased lot in the event of late or non-payment.
5. Taxes
Applicable sales tax will be collected on all purchases, whether through auction or fixed-price sale through the shop, in accordance with the tax laws of the jurisdiction to which the item is shipped or delivered. Buyers who hold a valid, unexpired state resale certificate applicable to the category of goods being purchased may be exempt from sales tax on qualifying purchases. It is the buyer’s responsibility to provide the certificate to Baer & Bosch prior to the completion of the transaction. Expired certificates will not be accepted. Exemptions will not be applied retroactively.
International buyers are solely responsible for any import duties, VAT, customs fees, or other local taxes and charges that may apply to their purchase. Baer & Bosch has no responsibility for and makes no representations regarding the import regulations of any jurisdiction.
6. Shipping and Delivery
Baer & Bosch ships all purchased lots via UPS with insurance and a tracking number. A signature is required upon delivery without exception. Baer & Bosch determines the shipping method and carrier at its sole discretion. Requests to ship via alternative carriers or methods will not be accommodated. No lot will be released for shipment until payment has been received in full and the buyer has completed our required shipping form.
Buyers are responsible for all shipping, insurance, and handling costs. Risk of loss during shipping is governed by the terms of the applicable carrier. Baer & Bosch is not responsible for any loss, damage, or delay caused by a third-party carrier once the lot has been handed to the carrier.
If a package is refused by the buyer, returned to sender, or deemed undeliverable for any reason, including failure to be present to sign for delivery, the buyer shall be responsible for all costs incurred as a result, including but not limited to return shipping fees, carrier surcharges, duties, customs fees, and any costs associated with reshipping. No refund will be issued under any circumstances. Baer & Bosch reserves the right to invoice the buyer directly for all such costs. Lots will not be reshipped until all outstanding costs have been paid in full.
International shipments are subject to the customs regulations of the destination country. Buyers are responsible for compliance with all applicable import regulations and for payment of any associated duties or taxes.
7. Seller Payments and Consignments
Payment to Consignors
Proceeds from the sale of consigned lots will be remitted to the consignor by bank wire transfer only. No checks or money orders will be issued. Payment will be made within approximately 45 days from the date on which full payment from the buyer has cleared and been received by Baer & Bosch. The 45-day period does not begin until buyer payment has cleared in full.
Consignor Representations
By consigning a lot for sale, the consignor warrants that they are the rightful owner of the property or are duly authorized to consign it for sale, that the property is free and clear of all liens, encumbrances, and claims, and that the consignor has the full right to sell the property. The consignor agrees to indemnify and hold harmless Baer & Bosch from any claims arising from a breach of these representations.
Clawback
In the event that a sale is voided, cancelled, or reversed for any reason after proceeds have been remitted to the consignor, including but not limited to a buyer dispute, chargeback, fraud, or court order, the consignor agrees to return to Baer & Bosch all proceeds received in connection with that sale upon demand. Baer & Bosch reserves the right to offset any amounts owed by the consignor against future sale proceeds or to pursue any available legal remedy to recover such amounts.
Provenance Disclosure
Information provided by the consignor regarding the provenance, history, or attribution of a lot may be included in the auction catalog listing and post-sale records. Consignors should not provide information they do not wish to be disclosed publicly. Where provenance information includes personally identifying details, we will discuss appropriate handling prior to publication.
Unsolicited Submissions
If you contact us with photographs, item descriptions, personal information, or any other materials without a prior arrangement, those submissions are made entirely at your own risk. Baer & Bosch is under no obligation to treat unsolicited submissions as confidential, to respond to them, to return any materials submitted, or to refrain from discarding them. Submitting materials without a prior agreement does not create any obligation on our part, commercial or otherwise.
8. All Sales Final
All sales are final. Baer & Bosch does not accept returns or offer refunds except in the sole and limited circumstance where a lot is determined, at Baer & Bosch’s sole discretion, to be a deliberate forgery that was not reasonably detectable at the time of sale. In such cases, the buyer must notify Baer & Bosch in writing, must return the lot in the same condition as sold, and the remedy shall be limited solely to a refund of the hammer price and buyer’s premium paid. No other remedy, compensation, or liability of any kind shall be available. This exception does not apply to disputes regarding condition, authenticity of individual components, provenance, or any matter covered elsewhere in these Terms & Conditions.
9. Copyright and Intellectual Property
All original content on the Site, including but not limited to catalog copy, photography, editorial articles, layout, and design, is the property of Baer & Bosch Auctioneers, Inc. and is protected by United States and international copyright law. No content may be reproduced, copied, modified, distributed, published, or otherwise used without the prior written permission of Baer & Bosch.
Product names, logos, trademarks, and brand identifiers referenced or depicted on the Site in connection with auction listings and catalog descriptions are the property of their respective owners. Such references are made solely for identification and descriptive purposes in connection with the resale of pre-owned goods and do not imply sponsorship, affiliation, or endorsement by those brand owners of Baer & Bosch or its activities.
Your use of the Site does not grant you any rights in the content, trademarks, or intellectual property of Baer & Bosch or any third party.
10. Prohibited Use
By accessing the Site, you agree that you will not, under any circumstances:
- Attempt to gain unauthorized access to any part of the Site, its servers, or any system or network connected to the Site
- Introduce, transmit, or distribute any virus, malware, spyware, ransomware, or other malicious or harmful code
- Use automated tools, bots, scrapers, crawlers, or similar technology to access, extract, copy, or monitor any content, data, images, pricing, or other information from the Site without the prior written permission of Baer & Bosch
- Copy, reproduce, download, republish, or redistribute any images, catalog copy, photographs, or other content from the Site without the prior written permission of Baer & Bosch
- Use any content, images, or data from the Site for any commercial purpose without authorization
- Attempt to interfere with, disrupt, or overload the Site or its infrastructure through any means, including denial of service attacks
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation
- Impersonate Baer & Bosch, its employees, or any other person or entity in connection with the Site or any auction
Baer & Bosch reserves the right to suspend or permanently ban any user found to be engaging in prohibited conduct, and to pursue all available legal remedies including claims for damages. Unauthorized use of our content, images, or data may constitute copyright infringement and will be treated accordingly.
11. Inquiries and Submissions
The Site includes a product inquiry form through which prospective buyers may submit their name, email address, phone number, and a message regarding a specific lot. By submitting an inquiry, you acknowledge and agree to the following:
Submitting an inquiry does not constitute a purchase, a binding offer, or any reservation of the lot. Baer & Bosch is under no obligation to respond to any inquiry, hold any lot, or enter into any transaction as a result of an inquiry being submitted.
Information submitted through the inquiry form or through any other means of communication with Baer & Bosch is treated as non-confidential except to the extent described in our Privacy Policy. By submitting information to us, you represent that you have the right to do so and that the information is accurate.
Baer & Bosch accepts no responsibility for any loss or consequence arising from the submission of information through the Site or by any other means. Any information you voluntarily submit is done so at your own risk.
12. Third-Party Links
The Site may contain links to external websites not operated or controlled by Baer & Bosch. Such links are provided for convenience only and do not constitute an endorsement of the linked site or its content, products, or services. Baer & Bosch has no control over and accepts no responsibility for the content, privacy practices, or availability of any third-party site.
13. Site Disclaimer
The Site is provided on an “as is” and “as available” basis without warranty of any kind, express or implied. Baer & Bosch makes no representations regarding the availability, accuracy, reliability, or uninterrupted operation of the Site. We do not warrant that the Site will be free from errors, interruptions, viruses, or other harmful components.
Baer & Bosch accepts no responsibility for any failure to place, receive, or process a bid due to technical issues, connectivity problems, platform outages, or any other cause beyond our control. It is the bidder’s sole responsibility to ensure they have a reliable internet connection and functioning equipment prior to participating in any auction. Technical difficulties do not constitute grounds for cancellation of a sale, extension of bidding, or any claim against Baer & Bosch.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Baer & Bosch, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of the Site, your participation in any auction, or any transaction, even if advised of the possibility of such damages.
Baer & Bosch’s total liability to any buyer or seller in connection with any transaction shall not exceed the hammer price paid for the relevant lot.
Material contained in the Site, catalogs, advertisements, or any other publications of Baer & Bosch is presented on an indicative basis only, without any assumption of responsibility by Baer & Bosch for its accuracy or completeness.
15. Governing Law and Disputes
These Terms & Conditions shall be governed by and construed in accordance with the laws of the United States and the State of Wyoming, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms & Conditions or any transaction with Baer & Bosch shall be subject to the exclusive jurisdiction of the courts of the State of Wyoming.
Baer & Bosch reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction where necessary to protect its interests.
Nothing in these Terms & Conditions shall limit or exclude any rights which applicable law in your jurisdiction does not permit to be limited or excluded. Buyers located outside the United States are advised that local consumer protection laws may afford them rights in addition to those described herein. Such local rights are not waived by these Terms & Conditions, but all other terms remain in full force and effect to the extent permitted by applicable law.
16. Indemnification
You agree to indemnify, defend, and hold harmless Baer & Bosch and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of the Site, your participation in any auction, your breach of these Terms & Conditions, or any misrepresentation made by you.

We may update these Terms & Conditions at any time. The updated version will be posted on this page with a revised date. Your continued use of the Site or participation in auctions after any update constitutes acceptance of the revised terms. We encourage you to review this page periodically.
